Insolvency Rules 1986 – All change

The Insolvency Rules 1986 are likely to be replaced wholesale by new Rules later this year which are likely to provide, inter alia:

  • Debtor Bankruptcy Petitions will be determined by an adjudicator outside the Court.
  • No prescribed form of individual Statutory Demand or creditors Bankruptcy Petition (so presumably we can make one up?).
  • The removal of prescribed meetings e.g. for CVA/IVA.
